Dispute Resolution
Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact us to attempt to resolve the dispute informally. We will make good faith efforts to resolve any disputes within 30 days of receiving your notice.
Binding Arbitration
If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms of Use, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
- The arbitration shall be conducted in San Francisco, California
- The arbitrator's decision shall be final and binding
- Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction
- You waive your right to a jury trial and to participate in class action lawsuits
Exceptions to Arbitration
The following disputes are not subject to binding arbitration:
- Disputes seeking injunctive relief or other equitable remedies
- Small claims court actions (claims under $10,000)
- Intellectual property disputes
Class Action Waiver
You agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in class action lawsuits or class-wide arbitration.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for the resolution of any disputes arising out of or relating to these Terms of Use or your use of our services.
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms of Use constitute the entire agreement between you and Artisanstcustom regarding your use of our website and services, superseding any prior agreements or understandings.
